If you have been a resident at Sapphire Nursing at Wappingers (previously named Elant at Wappingers Falls) (the “Facility”) at any time from April 27, 2017, through March 7, 2020, or are the legal representative of someone who resided at the Facility during that time, a class action lawsuit may affect your rights.

This website advises you of the pendency of the class action lawsuit against the defendants Sapphire Nursing at Wappingers, LLC; Machla Abramczyk; Esther Farkovits; Richard Platschek; Robert Schuck; and Does 1-25. The lawsuit claims that Defendants violated the New York Public Health Law (“PHL”) § 2801-d by depriving residents of Sapphire Nursing at Wappingers (previously called Elant at Wappingers Falls) of “any right or benefit created or established for the well-being of the patient by the terms of any contract, by any state statute, code, rule or regulation or by any applicable federal statute, code, rule or regulation.” The Court has certified the suit to be a class action with respect to the PHL § 2801-d claims, and you have been identified as a Class Member.

DO NOTHING If you do nothing you will be included in this class action lawsuit and may receive money or benefits from a trial or settlement. However, you will give up the right to sue the Defendants for violations of PHL § 2801-d on your own.
EXCLUDE YOURSELF If you make a valid and timely request to exclude yourself from the class action lawsuit you will not receive any money or benefits that may be obtained. But, you will keep the right to hire your own attorney and sue any or all of the Defendants separately. The statute of limitations continues to run on any claims you may have.
